Terms and Conditions

(hereinafter referred to as "Terms and Conditions")

 

This document constitutes the Terms and Conditions applicable to the order of any online subscription made on the jemabonne.ca website (hereinafter referred to as "Jemabonne") sold by TVA Publications Inc., whose offices are located at 612 Saint-Jacques Street, Montreal, Quebec, Canada, H3C 4M8 (hereinafter referred to as "TVA") to the customer whose name appears on the subscription form (hereinafter referred to as "you" or the "Customer"). By subscribing to a magazine offered on Jemabonne (hereinafter referred to as the "Magazine(s))"), you agree to be bound by and comply with these Terms and Conditions, which constitute a legal agreement between TVA and you.

  1. SUBSCRIPTION

 1.1 Cost and billing

By subscribing to a Magazine on Jemabonne, you agree that TVA will charge you the price of your subscription, in Canadian dollars, plus applicable taxes, as indicated in the description of the Magazine at the time of your subscription on Jemabonne. This is the amount that will be charged by TVA to your credit card account, and it is this amount that you agree to pay, plus taxes and shipping and handling fees (where applicable). You are responsible for the actual payment of each Magazine to which you subscribe. The number of issues included in your subscription to the Magazine is indicated on Jemabonne and in your confirmation email. Special editions consist of and count as two (2) issues. In the event that your payment cannot be validated or processed by TVA, your subscription to the Magazine will not be processed and TVA has no obligation to process your subscription request.

1.2 Payment method

The only form of payment authorized and accepted by TVA on Jemabonne is payment by credit card (Visa or Mastercard). Payment by cheque or credit card (Visa or Mastercard) is accepted for paper notice subscriptions. TVA is not responsible for payment issues related to the operation of the external secure online payment system. Jemabonne is a secure shopping site. For subscriptions on Jemabonne, as soon as TVA receives your credit card payment, TVA will send you an email confirming your subscription to the Magazine. This confirmation notice will be sent to the email address you provided when you subscribed. We recommend keeping this email in a safe place as it is proof of your subscription agreement with TVA.

1.3 Purchase terms

Subject to Section 1.5, each subscription to a Magazine is an indeterminate-term subscription, meaning that the agreement between TVA and you remain valid as long as your payments are made according to the subscription period you choose, or as long as you decide not to terminate your subscription to the Magazine in accordance with Sections 1.9 and 1.10.

1.4 Rate changes

TVA reserves the right to change the subscription rates of its Magazines on Jemabonne at any time and without prior notice. If you are an active subscriber and TVA makes a rate change, a notice indicating the new rate will be sent to you by TVA: (A) at least 30 days prior to any rate change coming into effect; and/or (B) prior to your Magazine subscription renewal. You may change or cancel your subscription to the Magazine at any time.

1.5 Gift subscription

You can offer a gift subscription to the Magazine of your choice by: (A) visiting Jemabonne; (B) filling out a gift subscription form; and (C) providing your personal information as well as that of the person to whom you will be offering the Magazine subscription. Gift subscriptions do not automatically renew and expire at the end of the chosen subscription period. If you wish to renew a gift subscription, you must log in to your subscriber account on Jemabonne, click on "Manage my Subscription" and choose the option "Gift Renewal." You can also contact our Subscriber Services department (see contact information above) or fill out and return the paper renewal notice by mail.

1.6 Digital subscription

The Magazines are also offered as a digital subscription and can be viewed via the Zinio platform or any platform that we confirm is subject to replace it. You can purchase a digital subscription on Jemabonne by choosing the digital version of the Magazine. Your subscription will give you access to the Zinio version of the first issue of your Magazine when it is available. An email will be sent to you to inform you of the availability of the Magazine. 1.7 Damaged issue

If you receive a damaged issue of a Magazine or if you fail to receive an issue of a Magazine you are subscribed to, please contact our Subscriber Services department (see contact information above) as soon as possible. We will extend your subscription to the Magazine by one issue or, subject to the availability of the Magazines, send you the issue of the Magazine in question.

1.8 Suspending a Magazine subscription

You have the option to suspend your subscription to a Magazine for a maximum period of six (6) months. We will restart the delivery of your Magazine on the date agreed upon between you and TVA. To suspend your subscription to a Magazine, contact our Subscriber Services department (see contact information above).

1.9 Cancelling or terminating a Magazine subscription

You may cancel or terminate your subscription to a Magazine at any time by contacting our Subscriber Services department (see contact information above). Cancellation or termination of a Magazine subscription will result in the deactivation of its automatic renewal and will result in the end of delivery of unprocessed issues of that Magazine. Unprocessed issues of Magazines will be refunded in accordance with applicable laws.

1.10 End of your Magazine subscription

Your subscription to your Magazine is for an indeterminate period and therefore there is no end to your subscription as long as you make your payments according to the subscription period you have chosen and as long as you do not cancel or terminate your subscription to the Magazine in accordance with the terms of Section 1.9.

1.11 Exchange and refund

All delivered Magazines are non-exchangeable, non-refundable, and final sale. Do not hesitate to contact our Subscriber Services department (see contact information above) if you have any questions.

1.12 Gift with subscription

If your subscription offer included a bonus and/or a gift, the item in question will be sent with the first issue of your Magazine or separately by mail following the payment of your subscription, if applicable. Unless otherwise specified, any promotion offered by TVA when you initially subscribed to a Magazine does not apply should you renew your subscription to said Magazine. In addition, any renewal of a Magazine subscription will be billed at the then current price, according to the terms of Section 1.3 herein.

 

  1. DELIVERY

2.1 Processing time

TVA processes your Magazine subscription in a timely fashion. It may, however, take 4 to 8 weeks to receive the first issue of the Magazine to which you have subscribed. For the Magazine Les idées de ma maison, the delay can be up to 12 weeks. If you still have not received your first issue of the Magazine within the aforementioned deadline, we invite you to contact our Subscriber Services department (see contact information above). TVA is not responsible for any delays or clerical errors in the delivery address attributed to you.

2.2 Delivery methods

Following your payment, TVA will send you your Magazine in printed version by mail by Canada Post's regular services or by our home delivery service. For digital Magazines, you will receive an email notification allowing you to access the first issue of your Magazine on the Zinio platform and you will also be able to access new issues in your virtual library when they are ready. The average delivery time for Canada Post and our home delivery service is 10 business days after the end of the processing time for your TVA subscription request. If you do not receive one or more issues of your Magazine within the time frame indicated above, please contact our Subscriber Services department (see contact information above). No additional shipping and handling fees are charged for the delivery of your Magazine in Canada, unless otherwise indicated at the time of placing your subscription order on Jemabonne. If delivery and handling fees are to be added to the Magazine's stated price, these fees will be clearly indicated at the time of your purchase, and you will have the opportunity to refuse them and cancel your order.

 

  1. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable laws, TVA is not responsible for any circumstance beyond its control, including computer breakdowns, strikes, lockouts, and postal problems.

For a precise description of the Magazines, you must refer to the descriptive text concerning them, bearing in mind that TVA may mention certain characteristics and specifications. TVA takes great care to ensure the accuracy of the information provided. However, TVA does not guarantee that the information and description of the Magazines offered for subscription on Jemabonne are accurate, complete, reliable, or error-free.   1. INTELLECTUAL PROPERTY

4.1 Copyright

TVA owns the copyright or the required authorizations in the content of the Magazine and these are protected by intellectual property rights and other applicable laws. Subject to applicable laws: (A) no reproduction, including the partial reproduction and creation of derivative works based in whole or in part on one or more of the contents of a Magazine, regardless of the means or process used, is permitted without the prior written consent of TVA; (B) it is strictly forbidden to use any trademark of TVA or third parties without the prior written permission of TVA or their respective owners.

 

  1. PERSONAL INFORMATION

 5.1 General

You agree and confirm that any personal information provided by you to TVA when subscribing to the Magazine is accurate and acknowledge that you have been informed that: (A) this personal information will be used to manage your customer file (provision of your subscription to the Magazines and billing); (B) information will be accessible only when necessary; (C) your file will be kept by TVA’s Subscriber Services department; (D) You have the right to access or request correction of the personal information contained in your file. You may do so by submitting a written request to the following email address: vieprivee@quebecor.com. You agree to promptly notify TVA of any changes to the personal information you formerly provided to TVA.

5.2 Privacy policy

Personal information that you provide to us via Jemabonne will be used only in accordance with these Terms and Conditions, as well as our Privacy policy. By providing your personal information, you consent to its use in accordance with these Terms and Conditions, as well as our Privacy policy.

 

  1. NOTICE ON MINORS

Jemabonne is not intended for and does not target minors. Minors who wish to purchase a subscription to a Magazine must do so under the supervision and with the authorization of their parents, holders of parental authority, or guardian.

 

  1. GENERAL PROVISIONS

7.1 Applicable laws

This agreement is interpreted in accordance with the laws in force in the province of Quebec. You are entitled to all rights and obligations that a consumer may have under any applicable law or regulation. The agreement is deemed to be concluded at your address.

7.2 Divisibility

The invalidity or unenforceability of any provision hereof shall not affect in any way the validity or enforceability of any other provision.

7.3 Waiver

Failure on TVA’s behalf to insist upon the strict performance of any provision of this agreement or its failure to enforce it shall not be construed as a waiver of the application of any provision or right.
